The Office of the Work Health and Safety Prosecutor (OWHSP) is an independent prosecutions office established under the Work Health and Safety Act 2011. The OWHSP conducts and defends proceedings under Queensland’s workplace and resources health and safety laws.
The Assistant Work Health and Safety Prosecutor (AWHSP) is an expert prosecutor and experienced manager. The AWHSP is integral to the delivery of high-quality prosecution service by the OWHSP.

Why join us? The Office of the Work Health and Safety Prosecutor (OWHSP) plays a vital role in ensuring safe workplaces across Queensland.
The OWHSP is responsible for:
- Instituting and defending proceedings, including criminal prosecutions and civil penalty proceedings under:
- the Work Health and Safety Act 2011, Electrical Safety Act 2002 and the Safety in Recreational Water Activities Act 2011 (WHS Acts); and
- the Coal Mining Safety and Health Act 1999, Explosives Act 1999, Mining and Quarrying Safety and Health Act 1999 and Petroleum and Gas (Production and Safety) Act 2004 (Resources Safety Acts).
- Applying the Guidelines of the Director of Public Prosecutions in determining whether or not to commence criminal prosecutions.
- Providing advice to the Work Health and Safety Regulator on matters arising under the WHS Acts, and the Resources Safety and Health Regulator on matters arising under the Resources Safety Acts.
What we are looking for: The Assistant Work Health and Safety Prosecutor reports to the Work Health and Safety Prosecutor. The key capabilities for this role are aligned with the OIR Capability Framework and the Leadership competencies for Queensland under the leadership stream: Program Leader. The key capabilities include relevant, proven experience and capability in the areas of Vision, Results and Accountability (please see the attached role description for further information).
Mandatory qualifications or conditions: As Assistant Work Health and Safety Prosecutor, you will be admitted as a Legal Practitioner in a State or Territory of Australia, with a minimum of 5 years post admission experience in criminal prosecutions, as well as demonstrated management experience.
