Your role

The successful appointee will undertake a range of straightforward legal matters under the supervision and guidance of more senior lawyers. The position of Legal Clerk requires the full completion of a law degree.

Your team

The areas of law handled within the A-G Advocacy Team include:

Dangerous Prisoners applications (85% of the workload)

  • Proceedings under the Dangerous Prisoners (Sexual Offenders) Act 2003.

Prosecutions and Mental Health Law (5% of the workload)

Providing advice on sufficiency of evidence and prospects of success and conduct of statutory prosecutions of simple and indictable offences including offences relating to:

  • workers' compensation fraud
  • consumer fraud
  • revenue fraud
  • marine safety and pollution
  • public health, drugs and poisons
  • food safety and standards
  • electoral prosecutions
  • housing and education prosecutions.
  • Proceedings under the Mental Health Act 2016 including proceedings in the Mental Health Court and Mental Health Review Tribunal

General advocacy (5% of the workload)

  • Coronial inquiries
  • Commissions of inquiry
  • QCAT representation
  • Professional regulation matters
  • General court attendances.

Written advocacy & general advice (5% of the workload)

Providing general advice on:

  • procedural matters relating to advocacy matters conducted by the team
  • work health and safety
  • regulatory investigations and law enforcement
  • general statutory interpretation.

Your key responsibilities

  • Perform, under close supervision, a range of legal work within the various legal practice groups of Crown Law. The duties within these legal practice groups may include:
    • redacting of documents
    • preparation of briefs
    • drafting of advice and other legal documents for more senior lawyers within A-G Advocacy, including the Assistant Crown Solicitor
    • assisting more senior officers in the conduct of legal matters including court proceedings
    • undertaking legal research and prepare papers
    • filing and serving of legal documents.
  • Legal clerks may also be required to assist with team administrative tasks and participate in and maintain a proactive approach to self-development, including:
    • achievement of CPD points
    • participation in Crown Law's performance management and development framework and any feedback processes.
  • Comply at all times with the office standards, including:
    • the client service charter
    • the requirement to meet set targets for billable hours
    • quality and timeliness measures
    • quality assurance framework.
